Terms of Service

EmberGrow is a macOS desktop application and cloud platform that uses artificial intelligence to help users engage with Reddit communities. The Service includes:

• The EmberGrow desktop application for macOS
• Cloud dashboard for analytics, account management, and configuration
• AI-powered comment generation and engagement automation
• Subreddit discovery and audience matching tools
• Account warm-up and reputation management features
• Associated APIs and backend infrastructure

EmberGrow is a tool to assist with Reddit engagement. The quality, reception, and consequences of content posted through the Service depend on many factors outside our control, including Reddit's algorithms, community moderation, and platform policies.

To use EmberGrow, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access to your account
• Ensuring that your account information remains accurate and up to date

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe are being used in violation of these Terms.

EmberGrow is a paid subscription service. By subscribing, you agree to the following terms:

• Billing -- Subscriptions are billed on a monthly or annual basis through Stripe, our payment processor. Your subscription begins on the date of your first payment.
• Auto-renewal -- Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current rate at the time of renewal.
• Cancellation -- You may cancel your subscription at any time through the dashboard or by contacting support. Upon cancellation, you retain access to the Service until the end of your current billing period.
• Money-back guarantee -- We offer a 7-day money-back guarantee for new subscribers. If you are unsatisfied, contact support within 7 days of your first payment for a full refund.
• Price changes -- We may adjust subscription pricing from time to time. You will be notified at least 30 days in advance of any price increase. Continued use after the price change takes effect constitutes acceptance of the new pricing.
• Failed payments -- If a payment fails, we will attempt to process it again over the following days. If payment cannot be collected, your access to the Service may be suspended until the balance is resolved.

You agree to use EmberGrow responsibly and in compliance with all applicable laws. You specifically agree not to:

• Violate Reddit's Terms of Service, Content Policy, or Moderator Code of Conduct
• Use the Service for spam, harassment, brigading, vote manipulation, or any form of platform abuse
• Generate or distribute content that is illegal, defamatory, hateful, or promotes violence
• Use the Service to spread misinformation, misleading content, or deceptive practices
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the application
• Share, transfer, or sell your account credentials to any third party
• Use the Service to circumvent bans, suspensions, or other actions taken against your Reddit accounts by Reddit or subreddit moderators
• Exceed the usage limits associated with your subscription plan, or attempt to circumvent rate limits
• Use the Service in any way that could damage, disable, or impair our infrastructure or interfere with other users' access

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending accounts, and reporting activity to law enforcement where appropriate.

You are solely and fully responsible for your Reddit accounts and any actions taken through them using the EmberGrow Service. This includes but is not limited to:

• All comments, posts, and interactions generated by the AI and posted to your Reddit accounts
• Compliance with individual subreddit rules and moderation policies
• Any consequences resulting from the use of your Reddit accounts with our Service, including account warnings, suspensions, or permanent bans by Reddit

EmberGrow provides tools and AI-generated suggestions, but you are ultimately responsible for all content posted through your accounts. We strongly recommend reviewing AI-generated content before it is posted and configuring appropriate safety settings within the application.

EmberGrow is not affiliated with, endorsed by, or officially connected to Reddit, Inc. in any way.

The EmberGrow application, website, documentation, branding, and all original content, features, and functionality are owned by EmberGrow and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your subscription period. This license does not include the right to:

• Modify, copy, or create derivative works of the Service
• Sublicense, sell, or redistribute the Service to any third party
• Use EmberGrow branding or trademarks without written permission

Content you create or generate using the Service (such as comments and engagement strategies) remains yours. However, you grant us a limited license to use anonymized and aggregated data derived from your usage to improve the Service.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

EmberGrow does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be appropriate for all subreddits or contexts
• The Service will achieve any particular results in terms of Reddit engagement, upvotes, traffic, or conversions
• Your Reddit accounts will not face moderation actions as a result of using the Service

You acknowledge that Reddit may change its platform, policies, or algorithms at any time, which may affect the functionality or effectiveness of the Service.

To the maximum extent permitted by applicable law, EmberGrow and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Reddit account suspensions, bans, or loss of reputation
• Costs of procuring substitute services
• Any damages arising from unauthorized access to your account

In no event shall our total aggregate liability exceed the amount you have paid to EmberGrow in the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.

You agree to indemnify, defend, and hold harmless EmberGrow, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Content posted through your Reddit accounts using the Service
• Your violation of these Terms
• Your violation of any applicable laws or third-party rights

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Engaging in abusive, fraudulent, or harmful behavior
• Non-payment of subscription fees
• Requests from law enforcement or government agencies

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

If we terminate your account for reasons other than a Terms violation, we will provide a pro-rata refund for any unused portion of your current billing period.

We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice through one or more of the following methods:

• Email notification to the address associated with your account
• A prominent notice within the EmberGrow application or dashboard
• A banner on our website

Material changes will take effect no sooner than 30 days after notification. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Delaware.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
